These Terms & Conditions will be effective on the date you participate in a trial or demonstration.

By booking a trial or demonstration, you agree to the following:

• Adapt Ability Ltd and its directors, employees and agents (collectively “Releasees”) are released from any and all claims, causes of action, suits, actions damages of whatsoever kind or nature, and demands (each a “Claim” and collectively “Claims”) arising under or relating to personal injuries and/or property damage, caused by negligence, or anything else, arising under or relating to their use of the Omeo personal mobility device (“Omeo”) for demonstration and trial.

• In exchange for using the Omeo for demonstration and trial purposes, you irrevocably agree to release the Releasees, individually and collectively, from any and all liability, including financial responsibility, for any and all Claims, and knowingly waives any and all rights to assert a Claim against any Releasees for any reason;

 

• Acknowledges you have been informed of the risks involved in the demonstration and use of the Omeo prior to its use. Those risks include but are not limited to losing control of the Omeo, accidentally injuring yourselves, others and damaging property. You also further acknowledge you are participating in the demonstration of the Omeo voluntarily and have had the opportunity to ask questions regarding those risks and all of those questions have been fully answered.

 

• You attest to have informed Adapt Ability Ltd personnel of any and all of medical conditions, functional and cognitive limitations or impairments for purposes of determining if they are suitable to use the Omeo; and you do not have any conditions beyond those disclosed to Adapt Ability Ltd that will increase the likelihood of injuries to yourselves, others or damaging property while engaging in this demonstration and trial. You also acknowledge that the safe user weight is between 40kg – 110kg. We are unable to provide a physical trial for anyone outside of this weight range without prior approval.

 

• You agree to obey all safety precautions verbally explained to you, or in writing if necessary, and to use the Omeo for the purpose for which it was designed and is made available, and, when needed, to ask for clarification as to the instructions, safety precautions and its safe use, and further agrees to take every precaution to ensure you, any other user of the Omeo, or any other party suffers no personal injury or damage directly resulting from the use of the Omeo.

 

By agreeing to these Terms & Conditions you release your legal right to take any legal, administrative or other action against Releasees for any and all claims you may have against the Releasees in connection with your use of the Omeo for demonstration and trial purposes. Adapt Ability Ltd makes available the Omeo “as is”. All implied warranties, including warranties of merchantability and fitness for particular purpose are expressly excluded.
